A Remainderman is the person (or entity) who is designated to inherit or take ownership of property after the termination of a preceding estate, such as a life estate. In estate planning and property law, the remainderman’s interest is considered a future interest—they don’t have possession of the property yet, but they hold the legal right to take possession once the current estate holder’s rights end.
For example, if a parent grants a life estate to their spouse, the spouse (called the life tenant) has the right to use and live on the property for the duration of their lifetime. Upon the spouse’s death, the property automatically transfers to the remainderman named in the deed or will—often the children.
Future Ownership Rights
The remainderman has no immediate right to use or occupy the property, but they are guaranteed ownership once the life estate ends.
Automatic Transfer
Upon the death of the life tenant, ownership of the property passes directly to the remainderman without the need for probate.
Protected Interest
Although the life tenant controls the property during their lifetime, they cannot usually sell or encumber the property in a way that defeats the remainderman’s interest.
May Coexist with Lady Bird Deeds
In Florida and some other states, enhanced life estate deeds (Lady Bird deeds) are commonly used. These allow the life tenant to retain control, including the right to sell or mortgage the property, while still designating a remainderman to inherit automatically at death.
Scenario: A mother executes a Lady Bird deed that grants herself a life estate in her home, with her daughter named as the remainderman.
During Lifetime: The mother lives in the home, pays taxes, and maintains the property. She retains the right to sell it if she chooses.
After Death: If she still owns the home, it automatically passes to the daughter as remainderman, bypassing probate.
Avoids Probate: Naming a remainderman ensures a smooth transfer of property without court involvement.
Clarifies Intent: The remainderman designation removes ambiguity about who should inherit the property.
Protects Beneficiaries: Provides peace of mind for heirs who know they have a guaranteed future interest.
